Invasive species are winning in the battle for survival against some native plants in a California reserve, according to a new study.
The research has troubling implications for plant hardiness, the scientists studying the plants said. While some researchers have believed the invaders merely supplement the native ecosystem, the new findings, published online earlier this month in the journal Proceedings of the National Academy of Sciences, show that a few of the original plants could die out in a few hundred years.
"What we see is a serious invasion, meaning that as one or more invasive species start to become abundant, the native plants shrink down in their habitat," said ecologist Benjamin Gilbert, who did field research during a temporary appointment at the University of California. He is currently with the University of Toronto.
Among other experiments, Gilbert and co-author Jonathan Levine planted plots of several native species, including the native flower Lasthenia californica, at the Sedgwick Reserve in the Santa Ynez Valley near Santa Barbara. Researchers then observed the plants' growth and modelled the long-term trend for the plants' survival based on the experimental results.
In general, Levine and Gilbert noted that the seedlings did not do very well in areas dominated by "exotic" grasses, such as Avena fatua, and that the population sizes of the native species are shrinking to critical levels.
Researchers have found that the number of total species in an area increases as exotics take hold and natives cling on to life. However, the native species are restricted to small "refugia," or isolated populations, located far apart from each other, which could hurt their long-term survival, Gilbert said.
Such isolated patches make the plants are more susceptible to damage frombeing hurt by disease or fire; plus, it's harder for them to disperse seeds.
"The native species are pushed out of the best habitat," Gilbert told OurAmazingPlanet. "The analogy for people is being taken off a really good diet ? it's getting them by, [but] it's not optimal."
Native species that have adapted to more challenging environments, such as rocky conditions, tend to fare better. "In this case, the only reason the natives seem to do well in these patches is it is so crappy for the invasives," Gilbert said.
As for protecting the native species, pesticides sometimes do more harm than good. It might be more effective, Gilbert suggested, to create a "corridor" of suitable habitat between patches of native species, which would help them again colonize larger areas.
One challenge, though, is that most of the native species develop naturally in small areas, although the invasives push them to sites that are much smaller than usual. This makes it difficult to study the impact of invasive species or to encourage the natural grasses and flowers to expand their habitats.

KAMPALA, Uganda (AP) ? Peace talks between the Congolese government and rebels believed to be backed by Rwanda have reached a standstill and could fail if regional governments deploy a neutral international force in eastern Congo, a lawyer for the M23 rebel movement said Thursday.
The government and M23 rebels are reviewing the terms of a March 23, 2009 agreement that the rebels accuse Congo's government of failing to honor. In November the rebels took the eastern city of Goma before withdrawing under international pressure. The rebellion forced thousands of villagers in Congo's North Kivu province to flee their homes.
Jean Baptiste Rudaseswa, the legal adviser for the M23 delegation to the peace talks, said he sees no progress in the negotiations. He said their last meeting was on Jan. 18, and that the M23 representatives now spend more time relaxing at their hotel.
It was not immediately possible to get a comment from Crispus Kiyonga, the Ugandan government minister who is mediating the talks.
M23 representatives and the Congolese government have been meeting in Uganda since Dec. 9 under the banner of the International Conference on the Great Lakes Region, or ICGLR, a regional bloc of which Congo is a member. A meeting last year of the ICGLR urged the Congolese government to listen to M23's "legitimate grievances." The ICGLR has also proposed the creation of a neutral international force to police eastern Congo, but it remains unclear what its mandate will be or where the troops will come from.
The peace talks started tensely, with both delegations offering accusatory accounts of who is responsible for violence in eastern Congo's North Kivu province.
"We do not see any progress," Rudaseswa said. "We did not come here because we were in a position of weakness...We declared a unilateral ceasefire and we now what we are seeing is a standstill. We are telling the Congolese government that either you talk or you fight. You can't do both at the same time."
The rebels are opposed to the deployment of a neutral international force, proposed by the ICLR, to fight "negative forces" in eastern Congo, Rudaseswa said. He accused the Ugandan mediators of failing to discourage talk of such a force.
In his opening statement Raymond Tshibanda, Congo's foreign minister, said M23 was a criminal organization that must be "eradicated." The talks would only be considered successful if they ended with the disbandment of M23, Tshibanda said in December.
M23 is made up of hundreds of soldiers who deserted the Congolese army last April after accusing the government of failing to honor the terms of a 2009 peace deal that incorporated them into the national army.
A U.N. report published last year accused the Rwandan government of backing the rebels, a charge Rwanda denies. The report also said some Ugandan military officers were helping arm the rebels and that the rebels' political wing operates freely in Kampala. Uganda has said the claims are baseless.
Scientists have discovered a puzzling spinning star that is spontaneously switching between two very different personalities, flipping between emitting strong X-rays and emitting intense radio waves.
While radio frequencies are known to vary as the star changes personalities, the newfound star is the first time example of variability in X-rays as well. The star, called a pulsar because it appears to pulse, has astronomers perplexed.
"When we look now to what is so far published in papers, nothing at this moment can explain what is happening," said the study's lead author, Wim Hermsen of the Netherlands Institute for Space Research and the University of Amsterdam.
Hermsen and his multinational research team suspect that changes in the spinning star's magnetosphere, or magnetic environment, are behind the switches. Those changes, however, is poorly understood.
"The people creating models will have to rethink what we are discovering here," Hermsen added. [Top 10 Star Mysteries]
Perplexing pulsar mystery
The newfound pulsar is officially known as PSR B0943+10. The 5 million-year-old spinning star whips through a rotation every 1.1 seconds? ? which is considered pretty slow for a star of its type, researchers said.
PSR B0943+10's radio pulses can change as quickly as once a second. The pulsar ? about 3,000 light-years from Earth ? also emits a weak X-ray signal as charged particles radiate along magnetic lines and bombard the magnetic poles.
Hermsen's team was interested in knowing whether the X-rays ? like the radio pulses ? varied between the two modes. They examined the pulsar using a European Space Agency X-ray space telescope, XMM-Newton, and combined those observations with work done at ground telescopes in the Netherlands and India.
They were surprised to find the pulsar switched between giving off strong radio pulses and emitting stronger X-rays. The mode switches took place at times ranging between half an hour and about five or six hours.
"The behavior of this pulsar is quite startling. It's as if it has two distinct personalities," said study co-author Ben Stappers, who is with the University of Manchester's School of Physics and Astronomy.
"As PSR B0943+10 is one of the few pulsars also known to emit X-rays, finding out how this higher energy radiation behaves as the radio changes could provide new insight into the nature of the emission process."
The research is detailed in the Jan. 25 edition of the journal Science.
Spinning star oddity
The researchers say the pulsar's quick switching between radio and X-ray brightness implies large changes in the magnetosphere. But what drives these changes is not known.
Some scientists have observed the change in radio brightness linked to the pulsar's spin rate. Older research suggests the radio waves vary with physical processes at the microscopic level, but the new findings challenge that. (X-ray brightness is even less understood because so few pulsars are visible in that wavelength.)
Changes in a pulsar's spin, the Science paper cautioned, are detectable only over a period of days. The research, however, suggests the magnetosphere may change in less time than it takes PSR B0943+10 to complete a single rotation.
Hermsen's team plans to compare the pulsar with similar objects to try to predict the X-ray emission behavior. Later this year it plans to look at another pulsar, PSR B1822-09, in both X-ray and radio wavelengths.
PSR B1822-09 will be observed with ground telescopes in India, the United Kingdom and the Netherlands along with the XMM-Newton space observatory.

Never mind rumors of an awkwardly named 4.8-inch "iPhone Math", the concept of a much larger iPhone has been floating about ever since the realities of early LTE chipsets -- and the batteries that came with them -- forced Android and Windows-based competitors to break the size barrier. Before the 16:9 iPhone 5 was announced, I examined some of the different ways Apple could go to 4-inches. More recently, following the launch of the iPad mini and the Droid DNA, I took a quick look at how Apple could achieve a 1080p+, 440ppi+ phone, one that would sit between 4-inches and 7.9-inches.
But it's worth a deeper look. Because, when you're dragging hundreds of millions of users, hundreds of thousands of developers, and hundreds of... hundreds of accessory makers behind your platform, it makes turning on a dime hugely problematic. Small, incremental steps, with adjustment periods after each, is the prudent way to go. And that's exactly how Apple has handled the iPhone so far.
Apple introduced the now-standard 1x pixel density, 3.5-inches at 480x320 and 163ppi, with the original iPhone in 2007. They introduced the Retina 2x density, 3.5 inches at 960x640 and 326ppi, with the iPhone 4 in 2010. They introduced the 16:9 aspect ratio, 4-inches at 1136x640 and 326ppi, with the iPhone 5 in 2012. If -- an it's a big if, no pun intended -- Apple intends to offer a larger screen alternative one day, it makes sense they'd do it in the same way. Let everyone get used to 16:9, let developers update their apps and accessory makers update their products, and then take the next step. Whether that's in 3 years like the switch to Retina, or 2 years like the switch to widescreen, or 1 year if acceleration continues, keeping things grounded as you push previous limits, and balancing stability with change, is how you move a platform forward.
So, asssuming we've not seen the last or the largest iPhone screen Apple ever makes, what steps could they take to get to 5-inches?
5-inches at 2x
The first way Apple could go to, or at least get closer to, 5-inches is simply by increasing the physical size of the current iPhone 5 display and keeping the 1136x640 pixel count the same. That would result in larger pixels, however, meaning lower pixel density.
At 4 inches, the the 1136x640 iPhone 5 has the same pixel density as the iPhone 4 and iPhone 4S, or 326ppi. What happens if you stretch that out close to 5-inches? Interestingly, it goes to 264ppi. That's the pixel density of the Retina iPad. It's a density Apple already manufacturers, much like the shrunken iPad mini display was also a density Apple already manufactured, the 163 ppi of the original iPhone, iPhone 3G, and iPhone 3GS.
Retina is a function of pixel density at distance. That's why, from 10-feet away, a reasonably sized 1080p television looks "Retina", and why the 264ppi iPad 4 looks as good from your lap as the 326ppi iPhone 5 does from your hand. Similarly, a 5-inch phone wouldn't need to be held as closely as a 4-inch phone. So, while it would certainly lose sharpness, there'd be some mitigation.
Developers and designers wouldn't have to create any new graphical assets to support a 5-inch iPhone at 264ppi. However, it would increase the size of existing interface, text, and other pixel-based on-screen elements and touch-targets, which could make them overly, borderline comically, large. (Except for people with visual accessibility issues who currently find the iPhone's interface elements and text too small to read comfortably.)
For videos and games, a scaled up screen is a plus. You could even shrink down a website or photo smaller to see more if it at the same physical size. Unlike to switch to the iPhone 5's 16:9 screen, however, there aren't any additional pixels. You're getting bigger, not more.
Going to 5-inches while staying at 2x could work, especially considering the step-by-step approach Apple's taken so far, but it's not ideal
5-inches at 3x
That's an example of, from left to right, of what happens when a display goes from standard, to Retina, has its size changed, or gets scaled by a non-integer amount (i.e. 1.5x). As you can see, it's fine in all cases but the last. That's the reason Apple went to 2x for Retina and not some arbitrary size -- it allowed them to maintain as much app compatibility as possible. When 1 standard size pixel becomes 4 Retina pixels (2x in each direction) everything still falls "on the grid" and stays nice and sharp.
Arguably, as densities get high enough, and displays far away enough, you no longer notice the blurring. But phones aren't held at arms length like a Retina MacBook Pro. If Apple wants to go closer to 5-inches, and add more pixels to do it, it makes sense they'd stick with multiples of the original screen size. So, after 2x, we have 3x. After 1136x640, we have 1704x960 which at roughly 5-inches is 391ppi. That's more pixels than 720p, and well past Retina.
Just like when Apple switched from 1x to 2x, a switch from 2x to 3x would mean developers and designers would need to create new @3x assets for their apps. Depending on how many graphics are in an app, that can be a lot of work.
The benefit is that you're not just getting bigger, you're getting more. Small text continues to look great, and when you zoom out, details on web pages or photos are still crisp.
On the downside, the more pixels you have, the more graphics power you need on the chipset to drive them, and the denser they get, the more LED you need to punch through and light them. That means more battery to drive them, and that's the reason the iPad mini isn't Retina.
Granted 1704x960 isn't 2048x1536 like the Retina iPad, but few people would want an iPhone anywhere nearly as thick and heavy as the Retina iPad either. (At least as it exists now...)
Going to 5-inches and increasing density to 3x feels like a double-step, but if the technology is in place to do it at the right lightness and thinness, it could also be the best compromise.
5-inches at 4x
That's how the various 5-inch iPhone options look when you compare them both in terms of pixel count (top) and physical scale (bottom), with an iOS standard touch-target grid overlay (44px). Yes, HTC has made 1080p (1960x1080) phones at 440ppi, which while positively pornographic, show what's already out and on the market. If Apple decides it wants to exceed that the way the original Retina display exceeded other panels at the time, they'd have to skip 3x and go straight to 4x -- 2272x1280 at 522ppi.
It would require even more graphics processing power, more light, and more battery, and it would be absolutely batshit insane, but hey, we're considering all options here.
Going to 5-inches at 4x probably isn't something within the current realms of technology, economics, or reason, however.
5-inches using the iPad mini display
While I won't call them phablets -- or tablones -- devices that blur the boundary between phone and tablet continue to be released. However, they're typically larger than 5-inches. 5.5-inches and now 6-inches are the norm. Also, unlike the iPhone 5, which has a 16:9 aspect ratio, and previous iPhones, which had 3:2 aspect ratios, the iPad has a 4:3 aspect ratio. In other words, it's wide. 1024x768 at 5-inches works out to 256ppi. If it were technologically possible cram a 2x iPad Retina display in there, 2048x1356 at 5-inches works out to 512ppi.
On the plus side, it would unify the app ecosystem and let the iPhone run iPad apps. On the minus side, if an iPhone interface starts to look ridiculously large at 5-inches, an iPad interface would be ridiculously, likely unusably, small at that same size. Existing iPhone apps, letterboxed, would probably be okay if they filled something close to their current 4-inch size. iPad apps would be another story entirely. The iPad mini is probably represents the bottom end of tap-target size, and shrinking from 7.9 to 5 would necessitate a stylus. The size of a toothpick.
Going to 5-inches by switching to an iPad display is a non-starter.
5-inches at some arbitrary or standardized pixel count
Other options include Apple switching from the traditional iPhone screen size, and its more modern multiples, to something arbitrary -- keeping the same 326ppi and just adding pixels to fill 5-inches -- or switching to a standard display size like 720p or 1080p.
To hit 5-inches at 326ppi, Apple would need to go to 1420x800 for the iPhone display size.
720p translates into 1280x720 and at 5-inches, that's 294ppi. 1080p translates into 1960x1080 and at 5 inches, that's 448ppi.
Neither approach seems to offer Apple any advantage over pixel trebling or even quadrupling, would result in scaled apps and interface elements falling off the grid and looking fuzzy, and create huge compatibility headaches in general for Apple, developers, and users.
Going to 5-inches at some arbitrary on standardized pixel gives you some of the benefits but all of the drawbacks and also seems like a non-starter.
4.5- or 4.8-inches
If Apple considers a screen size of 4.5- or 4.8- instead of 5-inches, the basic premises stay the same. Either way, if Apple stays at 2x, interface elements wouldn't be blown up as much at 4.5- or 4.8- as they would at 5-inches, nor would density decrease as much. At 4.5-inches the current 1136x640 display would be 290ppi, and at 4.8-inches it would be 272ppi. 3x would be 435ppi or 408ppi. 4x would be a silly 560ppi or 543ppi.
Given that, going to 4.5- or 4.8-inches could be a more reasonable alternative to 5-inches.
Yeahbuwhy?!
Apple has said as recently as the iPhone 5 introduction that they don't want to make a screen that the average person can't reach, corner-to-corner, with the thumb of one hand. And just like never making video iPods, or 7-inch tablets, Apple absolutely means that. Until they don't. That's why you can never say never with Apple.
For the sake of this discussion, lets assume there's a larger screen iPhone in the labs or sketched out on a napkin, or something. One handed ease of use is a feature that can be tackled in both hardware and software. Right now Apple's handling it in hardware. BlackBerry 10 will be tackling it in software, using corner gestures to allow for more navigation with less thumb travel. (Apologies for the gobsmacking cheesiness of this video, it's the only BlackBerry Flow example I could find.)
Apple's a really smart software company. If they ever go to 5-inches, they'll figure it out. (Hell, they'll invent it. But will they ever go to 5-inches? Not surprisingly, the go-to-market for a bigger iPhone echo and mirror those for a smaller iPad. From my previous post:

For some of those, size sells. Imagine you walked into a Big Box retailer and all the television sets, from 32- to 70+-inches all cost pretty much the same thing. Imagine the 70+-inch television, or even the 102-inch television, cost less than the 32-inch one. Thanks to carrier subsidies and agendas, that's the current situation for the iPhone. Customers walk into carriers or retailers and see the $199 iPhone on the shelf alongside 4.5- to 5-inch or bigger Android phones and Windows Phones. Bigger equals better, so they buy bigger.
For the rest, size matters. Either their eyes require bigger interface elements to easily use, their motor skills appreciate more room to move around, or they simply want a bigger screen to do bigger things with. Bigger web. Bigger videos. Bigger games. They might even want something approaching mini-tablet size, and would rather have a big phone than a small phone and a tablet. Bigger is better, so they buy bigger.
For both, even if they'd prefer an iPhone in many ways, the screen size is what they see, or what's more important to them than anything else. And because of that, neither of those customers is choosing the iPhone.
Or more simply put, if people are buying massive amounts of premium large-sized handsets, Apple could one day decide they'd rather those people buy premium Apple-made large-sized handsets than competing brands. If Apple sees value in increasing the scope of their addressable market, and thinks it will help them make a better product and sell more units, then that's why Apple would add a bigger iPhone to the mix.
Jan. 22, 2013 ? After a hospitalization, patients face many challenges as they transition home. A new study of this vulnerable period published by Yale School of Medicine researchers in JAMA found that a substantial number of patients return to the emergency department soon after leaving the hospital, and, while such patients are not usually readmitted, the study raises concerns that many more patients require acute medical care after hospital discharge than previously recognized.
A hospital's readmission rate is a marker of hospital quality of care and the success of patient transitions to outpatient care. However, hospital readmission rates may not tell the whole story.
"It's frustrating to see people ending up back in the emergency room so soon after leaving the hospital," said the study's lead author Dr. Anita Vashi, a Robert Wood Johnson clinical scholar at Yale. "It makes me wonder about the cause. Are we not educating them well enough about how to safely transition home? Or do we not have capacity in the system for their care team to coordinate follow-up care if they have a complication? Either way, care that is fragmented in this manner can lead to conflicting recommendations, medication errors, distress, and higher costs."
Vashi and her team studied over five million patients who were discharged from acute care hospitals across three states -- California, Florida, and Nebraska -- in 2008-2009. Nearly 18% of hospitalized patients returned to either the emergency room or were readmitted within 30 days following discharge. Medicare beneficiaries had even higher rates. Visits to the emergency room, which are not currently measured by hospital readmission rates, accounted for nearly 40% of all visits back to the hospital within 30 days after discharge.
"The big question is how many of these emergency room visits could have been avoided by tightening up our healthcare system, and ensuring close collaboration and communication between patients and their health providers inside and outside the hospital," said senior author Dr. Cary Gross, associate professor of internal medicine at Yale School of Medicine and director of the Cancer Outcomes, Public Policy, and Effectiveness Research (COPPER) center at Yale. "Future work should focus on identifying how to decrease the need for patients to seek emergency room care right after they leave the hospital."
Conditions with the highest emergency room rates were related to mental health, drug and alcohol abuse, and prostate issues. "High and varying rates of emergency room utilization suggest there is potential to improve care coordination and acute care delivery," said Vashi. "If we don't expand our view of post-acute care from readmissions to include emergency room visits, we will severely underestimate patient needs and system resources required to care tor them."
Other study authors include Dr. Justin P. Fox, Dr. Brendan G. Carr, Dr. Gail D'Onofrio, Dr. Jesse M. Pines, and Dr. Joseph S. Ross.

WASHINGTON (AP) ? President Barack Obama says the nation must make the "hard choices" to reduce the cost of health care and the size of the deficit.
But the president said every citizen deserves a basic measure of security and dignity, and he held up Medicare, Medicaid and Social Security as commitments that strengthen America.
Speaking in his inaugural address at the U.S. Capitol Monday, Obama said he rejected the belief that the country must choose between caring for the generation that built the country ? or investing in the generation that will build the future.
Struggles with Republicans over reducing the deficit and paring back costly entitlement programs loom for Obama in his second term.
TOKYO (Reuters) - Asian shares held steady on Monday after surging to multimonth highs last week, while the yen firmed after touching a new low in choppy trade ahead of a Bank of Japan policy meeting this week that is expected to yield bold monetary easing measures.
The MSCI's broadest index of Asia-Pacific shares outside Japan <.miapj0000pus> was steady after earlier easing as much as 0.3 percent. The index closed at a 17-1/2-month high on Friday as upbeat U.S. and Chinese data lifted sentiment.
Australian shares <.axjo> inched up 0.1 percent while South Korean shares <.ks11> recouped earlier losses but remained capped as a stronger local currency hurt exporters.
The focus in Japan was on the BoJ, which starts its two-day policy meeting on Monday under growing political pressure to pursue bolder measures to beat deflation, with speculation ranging from an open-ended commitment to buy assets until a 2 percent inflation target is achieved to simply boosting its asset buying schemes.
Early on Monday, the dollar touched a fresh 2-1/2-year high of 90.25 yen, and the euro rose to a high of 120.27 yen, near its peak since May 2011 of 120.73 hit on Friday.
But the yen clawed back some of its losses against the dollar and the euro. The dollar slipped back to a low of 89.42 yen and was last trading at 89.66 yen, while the euro also fell to a low of 119.08 and last traded at 119.44 yen.
"Profit taking pushed the dollar and the euro down against the yen but short covering lifted them off their lows. Trading is thin and quite volatile. I don't think there will be any clear direction until the BoJ decision," said Yuji Saito, director of foreign exchange at Credit Agricole in Tokyo.
Saito said "sell the fact" behavior could push the dollar down about 1 yen, but a serious disappointment on the BoJ outcome was unlikely.
The correction to the yen's years of excessive strengthening is now spurring adjustments to currencies such as the Korean won. A firmer won weighed on the Korea Composite stock Price Index <.ks11>, held back by exporters, and capping it near levels unchanged from Friday.
"Concern over the weakening yen appears to be playing a large part as the main board (Kospi) continues to underperform compared to Asian peers due to foreign selling," said Kim Joong-won, an analyst at NH Investment & Securities in Seoul.
Tokyo's benchmark Nikkei average <.n225> also slipped 0.9 percent as investors booked profits from the Nikkei's 2.9 percent rally on Friday, its biggest daily gain in 22 months. The Nikkei posted a 10th straight week of gains, its longest since 1987. <.t/>
Many investors largely keep short position on the yen.
"We expect the door for further easing will likely be left open irrespective of the outcome of BoJ policy meeting, either explicitly by the BoJ or implicitly through government's plan to nominate doves to replace the governor and deputy governors," Barclays Capital said in a note to clients.
Friday's data showed while currency speculators slightly cut their bets against the yen in the week to January 15, they remained overwhelmingly negative on the currency.

The steady showing in Asia equities followed a rise in global equities late last week when signs Washington may avert a fiscal crisis helped improve sentiment.
Republicans said the House will consider a bill to raise the U.S. debt ceiling enough to allow the country to pay its bills for another three months. The strategy would buy time for the Democratic-controlled Senate to pass a budget plan that shrinks the federal deficit.
The Dow Jones industrial average <.dji> and the Standard & Poor's 500 Index <.spx> ended Friday at five-year highs on a solid start to the quarterly earnings season. U.S. markets are closed on Monday for the Martin Luther King Jr. holiday.
Oil prices, however, took their cues from a weak consumer sentiment report in the United States, which showed a drop to the lowest in a year in January as a result of the uncertainty surrounding the country's debt crisis. Concerns about demand overshadowed supply disruption fears, reinforced by the Islamist militant attack and hostage-taking at a gas plant in Algeria, a member of the Organization of Petroleum Exporting Countries.
U.S. crude futures fell 0.4 percent to $95.21 a barrel while Brent fell 0.3 percent to $111.60 early on Monday.

BERLIN (AP) ? An exit poll points to a neck-and-neck race between Chancellor Angela Merkel's conservative-led coalition and the center-left opposition in a major state election that is a significant test ahead of a national vote later this year.
The ARD television exit poll Sunday showed Merkel's Christian Democrats winning 36 percent in Sunday's election for a new state legislature in Lower Saxony and their junior coalition partner, the Free Democrats, 10 percent.
The opposition Social Democrats and Greens hope to oust them from the regional government; the exit poll put their support at 32.5 and 13.5 percent respectively.
Merkel will seek a third four-year term in a national election expected in September. The opposition hoped for a boost from Lower Saxony.
Plenty of employees have chips on their shoulders. Some are hypersensitive to perceived slights and constructive criticism. Others get angry over minor problems.
Acting out has long been regarded as insubordination and grounds for discipline, including termination.
Recent case: Roberta, who is black, worked as a mail carrier. After returning to work from an injury, she got a new route. Soon, she was complaining that her supervisor was micromanaging her, criticizing how she delivered the mail.
The incident that led to her termination occurred when the supervisor sent another employee out on Roberta?s route, ostensibly to help her. Roberta sought out her supervisor and said, ?If [the employee] comes out here again, I?m going to kick her a**.? When the supervisor told Roberta to calm down, Roberta told her, ?You are not my boss?. You ain?t s**t and you can?t tell me what to do.?
Roberta was suspended for insubordination and then fired for that incident, plus a poor attendance record. She had missed 53 days without an excuse in a three-month period. Roberta sued, alleging race discrimination.
But the court didn?t buy it. To the court, it was clear that Roberta had been insubordinate, which was the main reason why she was terminated. She had no case, since she couldn?t show that anyone outside her protected class had missed so much work and also been insubordinate without being fired. (Matthews v. BAMAKO, Mali (AP) ? Burned out vehicles and scattered bullets dotted the streets of a central Malian town after radical Islamists retreated following days of French airstrikes, according to video obtained Sunday.
The Malian military announced late Saturday that the government was now controlling Diabaly, marking an important accomplishment for the French-led offensive to oust the extremists from northern and central Mali.
"People are calm since the Islamists left the city of Diabaly before it was taken by the Malian and French forces yesterday," said Oumar Coulibaly, who lives in the nearby town of Niono.
The Associated Press obtained video filmed Saturday by a local resident, which shows people from Diabaly inspecting the fighters' vehicles and charred weaponry destroyed by French airstrikes and Malian ground forces.
Several armored vehicles belonging to the Malian army also can be seen lying abandoned and damaged at the side of roads in Diabaly, a town of 35,000 that is home to an important military camp.
The video marks the first pictures to emerge from the area, which was taken over by al-Qaida-linked militants at the beginning of the week. The zone remains blocked off by a military cordon and journalists have not been able to access the area so far.
Also Sunday, French forces extended their deployment northward up from the central town of Markala, reinforcing their presence in the towns of Niono and Mopti, said Col. Thierry Burkhard, a French military spokesman.
Burkhard, speaking by telephone from Paris, said he could not confirm claims that Malian troops had recaptured Diabaly. Other French soldiers said the situation there remained murky.
"In theory, there are few or no rebels there, but that needs to be confirmed, so we will wait to see what happens in the days to come over there," said Lt. Col. "Frederic", a French Foreign Legion spokesman in Mali. His family name wasn't provided in keeping with French operational military policy.
Residents who had fled to the nearby town of Niono and officials described how Islamists fled the town on foot after days of French airstrikes that destroyed their vehicles.
"They tried to hijack a car, but the driver didn't stop and they fired on the car and killed the driver," said a Malian intelligence officer who spoke on condition of anonymity because he was not authorized to speak to journalists.
As they work to root out the jihadists and secure local populations, French and Malian forces also have to contend with some villagers who have lined up behind the rebels.
"The war against the Islamists is not at all easy and there's a very small part of the population which is helping their cause," said Col. Seydou Sogoba, the Malian force commander in the Niono region. "That is what is making the fight against them tough."
The radical Islamists first seized control of the main towns in northern Mali nine months ago, taking advantage of a power vacuum after a military coup in the distant capital of Bamako.
West African regional neighbors talked of a military intervention to retake northern Mali for months, but it was not until the French began their offensive Jan. 11 that the Islamists faced a military threat to their grip on power.
The Islamists took Diabaly several days later ? 270 miles (430 kilometers) away from the capital ? as part of an alarming descent into central Mali and closer to the government seat of power in Bamako.
France, which as of Saturday had 2,000 troops in Mali and continued to ramp up, wants African forces to eventually take the lead. The French foreign minister, attending a West African summit in Ivory Coast on Saturday that focused, said such a handover could take weeks.
Neighboring countries are expected to contribute around 3,000 troops to the operation. While some initial contributions from Togo, Nigeria and Benin have arrived to help the French, concerns about the mission have delayed other neighbors from sending their promised troops so far.
A donors' conference for the U.N.-backed Mali mission is set to take place in Ethiopia's capital on Jan. 29.

The DOL in October subpoenaed documents from Los Angeles-based apparel retailer Forever 21 that could show the company?s suppliers have been violating the minimum wage, overtime and record-keeping provisions of the Fair Labor Standards Act. When Forever 21 did not immediately turn over the documents, the DOL sued to force it to comply.
Note: The urge to protect suppliers and partners may show loyalty, but it also shows questionable business sense. Each company is responsible for obeying the law. Spending money to save another company from litigation is an unnecessary expense.

With his wife and two daughters at his side, President Barack Obama will raise his right hand and place his left on two stacked Bibles as he takes the oath of office for another four-year term. His second?inauguration?promises the pageantry of the first, but on a smaller scale than 2009, when a record 1.8 million people filled the nation's capital to witness Obama making history as America's first black president.

Obama has chosen to use two Bibles during his swearing-in ? one owned by Martin Luther King Jr. and the other by Abraham Lincoln. He used the Lincoln Bible while taking the oath four years ago. He is adding King's Bible for an?inaugural?ceremony that will take place on Jan. 21, the federal holiday honoring the civil rights leader.
At the 57th presidential?inauguration?a week from Monday, Chief Justice John Roberts will administer the oath of office to Obama and Supreme Court Justice Sonia Sotomayor will administer the oath to Vice President Joe Biden. It's a day rich in history and tradition.

Q: Why is the?inauguration?on Jan. 21 instead of Jan. 20?
A: The Constitution's 20th Amendment, passed by Congress in March 1932 and ratified by the necessary states the following January, sets the?inauguration?date as Jan. 20 at noon.
Because that's a Sunday this year, Obama will take the official oath of office that day in a private ceremony. A public ceremony will be held Jan. 21 on the west front of the U.S. Capitol. Local officials are planning for an estimated 600,000 to 800,000 people to crowd onto the National Mall to witness the oath-taking ceremony.
This is the seventh time the?inauguration?date has fallen on a Sunday.?Inaugural?ceremonies, however, are not traditionally held on Sundays because courts and other public institutions are closed.
Before 1933, the president had been sworn in on March 4, typically the final day of the congressional season. But the stretch between the November elections and the March 4?inauguration?led to a lengthy lame-duck sessions of Congress and became a concern during times of national crisis.
Sen. George Norris, R-Neb., suggested the 20th Amendment, which called for a new Congress to begin on Jan. 3 and for the president to be?inaugurated?on Jan. 20. President Franklin Roosevelt's first?inauguration, in 1933, was the last swearing-in ceremony held on March 4.
